Terms of Service

1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and AfterYou Inc. ("AfterYou", "we", "us"). By creating an account or using AfterYou.fyi, you agree to these Terms. If you do not agree, do not use the service.
2. Description of service
AfterYou.fyi provides a client-side encrypted digital estate vault: you encrypt personal information in your browser and designate recipients who may access specified contents following a missed check-in and a 14-day grace period. The service is currently in an invite-only early-access period.
3. Eligibility
You must be at least 18 years old and legally capable of forming a binding contract to use AfterYou.fyi. By using the service you represent that these conditions are met.
4. Your responsibilities
- You are solely responsible for safeguarding your encryption passphrase. We cannot recover it.
- You must provide accurate information about yourself and your designated recipients.
- You must not use AfterYou.fyi to store content that is unlawful, harmful to minors, or designed to facilitate illegal activity.
- You are responsible for ensuring your recipients understand the verification process required to access your vault.
5. Encryption and data access
All vault contents are encrypted in your browser before transmission. AfterYou stores only ciphertext. We have no technical ability to read your vault contents, and neither do our employees or contractors. Because of this architecture, we cannot recover lost passphrases or restore deleted vaults.
6. Check-ins and release
AfterYou sends periodic check-in reminders on a cadence you configure. If you miss a check-in and do not respond within the 14-day grace period, the service will initiate the recipient notification and identity verification process you have configured. You acknowledge that this automated release is an intended feature of the service, and that AfterYou is not liable for the release of vault contents that follow this process in good faith.
7. Not a legal instrument
AfterYou.fyi is not a will, trust, power of attorney, or any other legally recognised estate-planning instrument. It is a complementary tool. We strongly recommend consulting a licensed estate attorney for your broader planning needs.
8. Fees
During the early-access waitlist period the service is free. When accounts open, pricing is $49 as a one-time vault creation fee plus $9 per year for storage and maintenance. Fees are non-refundable after vault creation unless required by applicable consumer-protection law. We reserve the right to change pricing with 60 days' notice to existing customers.
9. Service continuity
We plan to establish an encrypted quarterly escrow with an independent estate-law trustee and to pre-fund a wind-down reserve to keep release infrastructure online for at least 5 years after any corporate dissolution. These are pre-launch roadmap commitments, not yet active during early access. 10. Intellectual property
AfterYou.fyi and its associated marks are owned by AfterYou Inc.. The client-side encryption library is open source (MIT licensed). You retain all rights to the content you encrypt and store.
11. Limitation of liability
To the maximum extent permitted by law, AfterYou's total liability for any claim arising from the service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the greatest extent permitted.
12. Termination
You may close your account at any time by contacting us at legal@afteryou.fyi. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, encrypted vault ciphertext is deleted within 30 days.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except either party may seek injunctive relief in any court of competent jurisdiction.
14. Changes
We may update these Terms. We will notify you by email at least 30 days before material changes take effect. Continued use of the service after that date constitutes acceptance.
